Merrill was driving south on Harmon Road near the intersection with U.S. Route 30, on June 17, 2011, when he ran through a stop sign. John Parrett was driving eastbound on US Route 30 near Harmon Road in Nelson when the two cars collided, according to the lawsuit.
The crash killed the driver and two of his passengers, Kimberley Gregorich and Inara Parrett, according to the lawsuit.
Plaintiffs Tiffany Parrett, Jeramie Morris and Elizabeth Johnson say they have been deprived of “comfort, society and valuable services,” as a result of the death of their loved ones.
Martin Company Excavating could not be reached for comment Tuesday evening. Merrill declined to comment on the pending litigation.
